Terms of Service

Welcome to CareLink. These Terms of Service (“Terms”) govern your access to and use of the CareLink website (the “Site”) and our related services, including all communication and bookings conducted through our official LINE Official Account (collectively, the “Platform”). By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Platform.
1. Definitions
"Client" refers to any individual or family using the Platform to search for, book, or engage a Caregiver.
"Caregiver" refers to any individual using the Platform to offer their caregiving services.
"User" refers to any visitor, Client, or Caregiver using the Platform.
"Care Services" refers to the caregiving services provided by a Caregiver to a Client.
"Booking" refers to the formal agreement between a Client and a Caregiver for the provision of Care Services, facilitated through our Platform.
2. Description of Our Platform
CareLink is a neutral technology platform that connects Families seeking care services with independent, professional caregivers. You acknowledge and agree that:
- We are a Connector: Our role is strictly limited to facilitating the connection between Clients and Caregivers.
- We Are Not a Healthcare Provider: CareLink does not provide medical advice, diagnosis, treatment, or any direct care services.
- We Are Not an Employer: Caregivers are independent contractors, not employees, partners, or agents of CareLink. We do not direct, control, or supervise Caregivers in their provision of Care Services. Clients are responsible for selecting their Caregiver and supervising the Care Services provided.
3. User Obligations and Conduct
As a User of the Platform, you agree to:
- Provide accurate, current, and complete information during registration and for your profile.
- Be at least 18 years of age.
- Maintain the confidentiality of your account information.
- Interact with other Users in a professional, respectful, and courteous manner.
- Use the Platform in compliance with all applicable laws and regulations in Thailand.
For Clients: You are responsible for clearly and accurately describing the care needs, verifying the suitability of a Caregiver for your specific requirements, and providing a safe environment for the Caregiver.
For Caregivers: You are responsible for accurately representing your skills, qualifications, and experience. You agree to perform Care Services professionally, ethically, and to the best of your ability.
4. Scope of Care Services
Service Definition: The scope of Care Services is strictly limited to the tasks specified in the official booking request form agreed upon by the Client and Caregiver. These services generally include assistance with Activities of Daily Living (ADL) and/or specific nursing tasks.
Included Tasks: Basic cleaning tasks directly related to the care recipient's personal hygiene are considered part of the scope. This may include cleaning the bathroom after use, tidying the immediate bedside area, and washing utensils used by the care recipient.
Excluded Tasks: To avoid misunderstanding, Care Services explicitly exclude general household chores. This includes, but is not limited to: general house cleaning, cleaning windows, laundry for the entire family, cooking for anyone other than the care recipient, and running errands not directly related to the care recipient's immediate needs.
Service Time Calculation: The billable service time is calculated from the moment the Caregiver arrives at the designated service location until the agreed-upon Care Services are completed and the Client (or their designated representative) signs off on the completion of the job.
5. Bookings, Fees, and Payments
Bookings: All Bookings must be made through our official LINE Official Account. A Booking constitutes a direct agreement between the Client and the Caregiver.
Service Fees: CareLink charges a service fee to the Client for facilitating the connection and booking. We also retain a portion of the payment as a fee from the Caregiver. These fees will be made clear during the booking process.
Payment: All payments for Bookings are processed through the channels specified by us. By making a Booking, you authorise CareLink to process the payment on behalf of the Caregiver.
6. Disclaimers
The Platform is provided on an "as is" and "as available" basis. CareLink makes no warranties, express or implied, regarding the reliability, quality, or suitability of any Caregiver or Care Services. We conduct basic screening of Caregivers, but we do not guarantee their conduct or the outcome of their services. Clients are solely responsible for conducting their own due diligence before hiring a Caregiver.
7. Limitation of Liability and Indemnification (IMPORTANT)
This section is crucial as it defines the extent of our legal responsibility.
No Liability for User Actions: CareLink serves as a neutral introductory platform. You acknowledge that any agreement for Care Services is between the Client and the Caregiver. Therefore, CareLink shall not be held liable for, and you agree to hold CareLink harmless from, any claims, damages, losses, injuries, or costs arising from any act of negligence, misconduct, or omission by any Caregiver or Client. This includes, but is not limited to, property damage, personal injury, or dissatisfaction with the Care Services provided.
Liability Cap: To the maximum extent permitted by law, the total liability of CareLink, its directors, and its employees to you for any and all claims arising from your use of the Platform is strictly limited to the total amount of service fees paid by you (as a Client) to CareLink for the specific Booking in question, or the service fees received by you (as a Caregiver) from CareLink for that same Booking.
Indemnification: You agree to indemnify, defend, and hold harmless CareLink from any claims, liabilities, damages, and expenses (including legal fees) arising out of your use of the Platform, your violation of these Terms, your provision or receipt of Care Services, or your interaction with any other User.
8. Confidentiality
Caregivers agree to maintain the strict confidentiality of all information obtained through the Platform. This includes, but is not limited to, the personal details, health conditions, addresses, and any other private information of Clients and their family members (collectively, "Confidential Information"). Caregivers shall not disclose any Confidential Information to any third party without the prior written consent of the Client, unless explicitly required by law.
9. Dispute Resolution
Disputes are to be resolved directly between the Client and the Caregiver. CareLink may, at its sole discretion, offer assistance to facilitate a resolution but is under no obligation to do so. These Terms are governed by the laws of the Kingdom of Thailand, and any legal proceedings shall be brought in the courts of Thailand.
10. Termination
CareLink reserves the right to suspend or terminate your account and access to the Platform at any time, without notice, for any reason, including but not limited to a breach of these Terms.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of any significant changes by posting the new Terms on the Site. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
